Terms and Conditions

By accessing, browsing, registering with or submitting content to Defaulter List (https://www.defaulterlist.in) you agree to be bound by these Terms. If you do not accept these Terms in full, you must not use the Platform.
1. Nature of the service
Defaulter List is a user-generated content platform and passive intermediary. We supply hosting and search functionality. We do not create, author, solicit, verify, endorse or adopt user content. All listings are the sole work and sole responsibility of the users who submit them.
We are not a credit bureau, credit information company, consumer reporting agency, background-verification agency, investigator, debt collector or dispute-resolution service, and we do not hold ourselves out as any of these.
2. Eligibility
You must be at least 18 years old and legally capable of entering into a binding contract. By using the Platform you represent that you meet these requirements and that all information you provide is true and current.
3. Your obligations when submitting a report
You are solely and personally responsible for everything you submit. By submitting a report you represent, warrant and undertake that:
a. the report is a truthful, accurate and good-faith account of your own first-hand experience in a genuine commercial dealing to which you were a party; b. you possess documentary evidence (contracts, invoices, correspondence, payment records) substantiating the factual claims you make, and will produce it on request; c. the report is not defamatory, malicious, retaliatory, vexatious, exaggerated, or filed to harass, extort, coerce, intimidate, blackmail or gain commercial advantage; d. you have a lawful basis to publish any personal data, photograph, email address or telephone number you include, and any image you upload does not infringe another person's copyright, privacy or publicity rights; e. the report does not disclose bank details, identity-document numbers, passwords, or other sensitive personal or financial data; f. publication does not breach any contract, court order, injunction, settlement agreement, confidentiality obligation or non-disparagement clause binding on you; g. the matter is not subject to active legal proceedings or a confidential settlement; h. you will promptly update or delete your report if the matter is resolved, paid, settled, or if you learn it is inaccurate.
4. Prohibited content
You must not submit content that is false, misleading, obscene, hateful, discriminatory, threatening, harassing, invasive of privacy, infringing of intellectual property, unlawful under any applicable law, or that names a minor, or that constitutes impersonation, spam or automated submission.
5. Indemnity
You agree to fully indemnify, defend and hold harmless Defaulter List, its owners, directors, officers, employees, contractors, agents and affiliates from and against any and all claims, demands, actions, proceedings, liabilities, losses, damages, penalties, fines, costs and expenses (including reasonable legal fees on a full-indemnity basis) arising out of or in connection with:
- any content you submit, publish or transmit;
- any breach by you of these Terms or of any warranty you have given;
- any violation by you of any law or of any third party's rights, including
- any claim brought by a person you have named in a report.

If a person named in your report brings a legal claim, that claim is your responsibility and you will bear its cost. This indemnity survives termination of your account.
6. Licence you grant us
You grant us a worldwide, non-exclusive, royalty-free, transferable, sub-licensable licence to host, store, reproduce, adapt, publish, display and distribute your submitted content for the purpose of operating, promoting and improving the Platform. You retain ownership of your content. This licence ends when your content is deleted, save for cached and backup copies retained for a reasonable period.
7. Moderation, and the limits of moderation
We may — but are under no obligation to — review, screen, edit, refuse, reject, remove, suspend or restrict any content, at our sole discretion and without notice or reason.
Our exercise of moderation does not make us the author or publisher of user content, does not constitute endorsement, and does not create any duty to monitor. Approving a listing means only that it did not obviously breach these Terms on a superficial review; it is not a finding that the listing is true.
8. Notice, takedown and grievance procedure
If you believe content is unlawful, inaccurate or infringes your rights:
- Contact the reporting user directly first. Users control their own
- If that is not possible or does not resolve the matter, send a written

- We may forward your notice, including its contents, to the user who posted
listings and can remove them immediately. This is nearly always the fastest resolution, and the underlying commercial dispute is between you and them.

9. Grievance Officer
For complaints under the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021, contact our Grievance Officer at legal@defaulterlist.in.
10. Accounts and security
You are responsible for maintaining the confidentiality of your credentials and for all activity under your account. Notify us immediately of any unauthorised use. We may suspend or terminate any account at any time, without notice, for any reason, including suspected breach of these Terms.
11. Disclaimer and limitation of liability
Our Disclaimer is incorporated into these Terms by reference and applies in full, including its exclusions and limitations of liability.
12. No guarantee of availability
The Platform is provided without any guarantee of uptime, continuity or data retention. We may modify, suspend or discontinue the Platform or any part of it at any time without liability.
13. Governing law and jurisdiction
These Terms are governed by the laws of India. The courts of India shall have exclusive jurisdiction over any dispute arising out of or relating to these Terms or the Platform, and you irrevocably submit to that jurisdiction.
14. Severability and entire agreement
If any provision is held invalid or unenforceable, it shall be severed and the remaining provisions shall continue in full force. These Terms, together with the Disclaimer and Privacy Policy, constitute the entire agreement between you and us regarding the Platform.
15. Changes
We may amend these Terms at any time by posting the revised version. Continued use after posting constitutes acceptance.
