1. We are a neutral platform, not the author of any report
Defaulter List ("the Platform", "we", "us") is an intermediary. We provide a technical facility that allows members of the public to publish their own accounts of commercial dealings. Every listing, description, name, image, amount and allegation published on this Platform is created, written, uploaded and submitted entirely by an independent third-party user.
We do not author any report. We do not commission any report. We do not adopt, verify, endorse, ratify or agree with any statement contained in any report. The views expressed in a listing are exclusively those of the user who submitted it.
2. We do not verify the truth of any report
We have no ability, obligation or practical means to investigate, authenticate, audit or confirm any claim made by a user. We do not examine contracts, invoices, bank records, correspondence or any other evidence. We do not contact the parties to establish facts.
Accordingly:
- No listing on this Platform is a statement of fact by us.
- No listing is a finding of fraud, dishonesty, default or wrongdoing.
- **No listing is a judgment, order, decree or determination of any court,
- A listing records one person's personal account of their own experience
tribunal, regulator or authority.**
and nothing more.
3. No professional advice and no reliance
Nothing on this Platform constitutes legal, financial, credit, investigative, accounting, or professional advice of any kind. The Platform is not a credit reference agency, credit bureau, background-check provider, consumer reporting agency or due-diligence service, and must not be used as one.
You must not make any business, credit, hiring, contracting or financial decision solely on the basis of information found here. You are solely responsible for conducting your own independent due diligence and for obtaining your own professional advice. Any reliance you place on Platform content is strictly at your own risk.
4. Content is provided "as is"
All content is provided on an "as is" and "as available" basis, without warranties or representations of any kind, whether express, implied or statutory, including without limitation any implied warranty of accuracy, completeness, currency, reliability, merchantability, fitness for a particular purpose, title or non-infringement. We do not warrant that content is accurate, current, complete, lawful or free of error, and we expressly disclaim any such warranty to the fullest extent permitted by law.
5. Limitation of liability
To the maximum extent permitted by applicable law, Defaulter List, its owners, directors, officers, employees, contractors, agents, affiliates and licensors shall not be liable for any loss or damage of any kind — including without limitation direct, indirect, incidental, special, punitive, exemplary or consequential loss, loss of profits, loss of revenue, loss of business, loss of goodwill, loss of reputation, loss of opportunity, loss of data, or business interruption — arising out of or in any way connected with:
- any content published, submitted, transmitted or removed by a user;
- the accuracy, inaccuracy, presence or absence of any listing;
- any act, omission, decision or reliance by any person based on Platform
- any dealing, transaction, dispute or communication between users, or between
- any unavailability, interruption, suspension or discontinuation of the
content;
a user and any person named in a listing;
Platform.
This limitation applies regardless of the legal theory advanced (contract, tort, negligence, strict liability, statute or otherwise) and even if we have been advised of the possibility of such loss.
Where liability cannot lawfully be excluded, our aggregate liability to any person for all claims is limited to the greater of (a) the total amount that person has paid us in the twelve months preceding the claim, or (b) INR 1,000.
6. Disputes are between the parties, not with us
If you are named in a listing, your dispute is with the user who published it — not with the Platform. We did not make the statement about you and we have no independent knowledge of the underlying facts.
The fastest and most effective route to resolution is to contact the reporting user directly and resolve the underlying commercial matter. Users retain full control of their own listings and may edit or delete them at any time.

7. Intermediary status and safe harbour
We assert and rely upon all protections available to intermediaries and hosting providers under applicable law, including without limitation Section 79 of the Information Technology Act, 2000 (India) and the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021, and equivalent safe-harbour provisions in other jurisdictions.
We do not initiate transmissions, do not select the receiver of any transmission, and do not select or modify the information contained in user submissions. We observe due diligence as required of an intermediary and act expeditiously on valid legal notice.
